Please read these terms carefully before using Setlwork.

Introduction
These Terms & Conditions (the “Terms”) govern your access to and use of the website setlwork.com and related services (the “Service”) provided by Setlwork Ltd, a company registered in England and Wales, with registered address at Office 1, Izabella House, 24-26 Regent Place, Birmingham, West Midlands, B1 3NJ (referred to as “Setlwork”, “we”, “us”, “our”). By creating an account, purchasing a plan, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

1. Eligibility
- You must be at least 16 years old to use the Service.
- If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Your Account
- Keep your login credentials confidential. You are responsible for activity under your account.
- Provide accurate, up‑to‑date information. We may suspend or close accounts for breach or abuse.
3. Subscriptions, Billing and Taxes
The Service may be offered on a subscription basis (monthly or annually, as shown at checkout). Subscriptions auto-renew at the end of each term unless cancelled before renewal.
- You authorise us and our payment processor to charge your chosen payment method for subscription fees, applicable taxes (e.g., VAT), and any add-on purchases.
- Prices may change. We will give prior notice where required. Continued use after a price change constitutes acceptance.
3.1 Free Trials and Promotions
If you start a trial, it converts to a paid plan unless you cancel before the trial ends. Only one trial per user/organisation unless stated otherwise.
3.2 Cancellations and No-Refund Policy
- You can cancel any time, and your access continues until the end of the current billing period.
- We do not provide refunds or credits for partial months/years, downgrades, or unused time except where required by law.
- For users in the UK/EU: you may have a statutory 14-day cooling-off period for distance purchases. By starting the Service immediately on sign-up and ticking the relevant consent box, you acknowledge that the Service begins during the cooling-off period and you lose the right to cancel for a refund once access starts.
- We may, at our sole discretion, offer goodwill credits; such gestures do not waive this policy.
3.3 Chargebacks and Payment Issues
Unauthorised chargebacks may result in suspension or termination. If a payment is reversed, you remain responsible for the outstanding amount.
4. Acceptable Use
You agree not to:
- break the law or infringe others’ rights;
- Do not reverse engineer, decompile, or scrape except as permitted by law.
- Do not upload harmful or unlawful content.
- Do not attempt to bypass security or rate limits.
- Do not use the Service to create competing datasets/services in breach of these Terms.
- Do not misuse scoring outputs; always use human judgment.
We may monitor misuse and enforce these Terms.
5. Intellectual Property
We and our licensors own all rights in the Service and its content. All trademarks, logos and brand features are our property or that of third parties.
You retain ownership of content you upload (e.g., CVs). You grant us a worldwide, non-exclusive licence to host, process, and display such content solely to operate and improve the Service.
6. Third‑Party Services
The Service may integrate with third-party tools (e.g., hosting, analytics, job boards). Your use of third-party services is subject to their terms. We are not responsible for third-party services.
7. Availability and Changes
We strive for high availability but do not guarantee uninterrupted service. Maintenance and updates may occur. We may change or discontinue features at any time and will take reasonable steps to notify affected users where paid functionality is materially impaired.
8. Beta/Experimental Features
From time to time we may offer beta features. They are provided “as is”, may be unstable, and can be withdrawn without notice.
9. Data Protection & Privacy
Our Privacy Policy explains how we process personal data and forms part of these Terms. You must not upload special category data unless strictly necessary and lawful.
10. Warranties and Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
Outputs (including scores and recommendations) are informational only and should not be the sole basis for decisions.
11. Limitation of Liability
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited or excluded.
- Subject to the above, we will not be liable for: (a) loss of profits, revenue, data, or goodwill; (b) indirect or consequential losses; (c) losses not reasonably foreseeable.
- Our total aggregate liability arising out of or relating to the Service in any 12-month period is limited to the amount you paid for the Service in that period.
12. Termination
You may stop using the Service at any time. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate access if you breach these Terms, create risk to us or other users, or for non‑payment. We will try to give notice where reasonable.
13. Complaints and Disputes
Contact us first at support@setlwork.uk. We will try to resolve issues informally.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident elsewhere in the UK/EEA may bring claims in their local courts as required by law.
14. Communications
We will communicate with you electronically (email, in‑app notices). Notices are deemed received when sent to your registered email.
15. Changes to these Terms
We may update these Terms from time to time. We will post the latest version on setlwork.com and, where changes are material, provide reasonable notice. Your continued use after updates constitutes acceptance.
16. Miscellaneous
- Severability: If a provision is unlawful or unenforceable, the rest remains in effect.
- No waiver: Failure to enforce is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a business transfer.
- Entire agreement: These Terms (and policies referenced here) are the entire agreement between you and us about the Service.
- Force majeure: We are not liable for events beyond our reasonable control.
- Statutory rights: Nothing in these Terms affects your legal rights as a consumer where applicable.
